In the Matter of City of Hagerstown, et al., No. 2114, Sept. Term 2023. Opinion by Arthur, J. WORKERS’ COMPENSATION—DE NOVO JUDICIAL REVIEW At a de novo trial for judicial review of a decision by the Workers’ Compensation Commission, the jury reviews the “decision” of the Commission, rather than the opinion or findings of the Commission. A “decision” of the Commission is an operative order with the effect of granting or denying some benefit under the Act. If the jury concludes that the decision was correct, the jury should uphold the decision even if the jury disagrees with factual findings…
