The plaintiff, as the widow of W. R. King, deceased, filed her petition in the probate court, asking an allowance out of her deceased husband’s estate for the year’s supply of provisions, etc., provided for in sections 105 and 106, Revised Statutes, 1889. She had judgment in both the probate and circuit courts and the executor appealed.
