GIERKE, Justice.
M.B. appeals from an order of the Bur-leigh County Court committing him to the North Dakota State Hospital for 90 days to receive treatment for mental illness. We reverse.
M.B. was brought to the Emergency Room of St. Alexius Medical Center by police. Pursuant to Section 25-03.1-25(1), N.D.C.C., M.B. was committed to the St. Alexius Medical Center on an emergency basis upon the application of Dr. T.
