This case is before this Court upon appeal of a final order of the Circuit Court of McDowell County entered on December 29, 2000. In that order, the circuit court granted summary judgment in favor of the appellee and defendant below, Aireo Heating and Cooling, Inc. (hereinafter “Aireo”) in this wrongful death action filed by the appellant and plaintiff below, Carol Lockhart, Administratrix of the Estate of Shirley Lockhart.
