THIS CAUSE having come before the Court on Defendant’s Motion to Suppress on December 22, 1987 and the Court having heard testimony therein, finds as follows:

The evidence showed that Pierson Police Chief George Leary received a phone call with regard to a vehicle in a ditch. The wrecker *39operator would not remove the vehicle without authorization from the police department.
