In a false imprisonment suit tried in 1972, plaintiff received a jury verdict and judgment for $10,000 against defendants. The judgment was reversed and remanded for a new trial by a panel of this Court in an unpublished opinion holding that the jury verdict was against the great weight of the evidence. Clark v Katz, unpublished per curiam, No. 16985, released August 16, 1974. Costs were awarded to defendants, and were taxed in the amount of $751.75.

Upon remand, defendants petitioned the trial court to stay the new trial until plaintiff paid defendants the costs taxed by the Court of Appeals.…
