LYNNE, Senior District Judge:

The plaintiff, Dr. Alfredo E. Suarez, sued the defendant, American Telephone & Telegraph Company (AT & T), for injuries to plaintiff’s blueberry crop caused by nuisance and negligence. In his complaint, the plaintiff alleged that the defendant interfered with drainage from plaintiffs land, and so caused extensive damage to plaintiffs blueberry plants. The case was tried to a jury, which returned a general verdict for the plaintiff in the amount of $74,400.00. After a timely motion for judgment notwithstanding the verdict and for new trial, the defendant appeals.…
