This action was brought to recover compensation from the defendant for injuries received by the plaintiff through being run down by a locomotive engine at the railroad crossing at Eront street, in the city of Newark.

*409The accident occurred on the 25th of March, 1914, shortly after six o’clock in the evening and while it was yet daylight.
