It is a suit for the specific per formance of a contract for the exchange of lands in the - State of Kansas between Maria W. McAlpiné, one of the complainants below and appellees here, and the Kansas Pacific Kailway Company, alleged to have been made in 1878, her contention being that the defendant, the Union Pacific Kailway Company, has succeeded 'not only to the property but to the obligations of that company.
