Petitioners have instituted an article 78 proceeding questioning the legality of the action taken by the Board of Education of the West Genesee Central School District (Board) in authorizing the closing of the Camillus Elementary School prior to the filing of an environmental impact statement. The petitioners allege that the Board failed to comply with the provisions of ECL 8-0113 (ECL art 8, entitled "State Environmental Quality Review Act” [SEQRA]) and the applicable regulations.
