Presently pending before the court in the above-captioned cause are cross motions for summary judgment filed by plaintiffs and defendants pursuant to Fed.R.Civ.P. 56. Plaintiffs are a group of 43 retirees formerly employed by defendant Teledyne, Inc. (hereinafter Teledyne) who instituted this cause with the filing of a complaint on August 27, 1991. Plaintiffs subsequently filed an amended complaint (hereinafter the complaint) on February 3, 1992.
