Floyd County filed a petition against D. G. Johnson as sheriff of said county seeking a declaratory judgment for the purpose of having determined the amount of fees which the sheriff was legally entitled to collect from the county for the performance of certain duties. The sheriff in his answer admitted substantially all of the allegations of fact in the petition. The case was tried before the judge of the superior court, without the intervention of a jury, on an agreed statement of facts; and the facts are that the sheriff has rendered services for which he seeks to have the county pay fees…
