The appellant was convicted on an indictment alleging that he “being then and there prior thereto a duly elected, qualified and acting member of the Board of Supervisors of Hinds County, Mississippi in and for beat three of said county did then and there wilfully, unlawfully, wantonly, fraudulently and feloniously with the intent to cheat and defraud Hinds County, Mississippi while acting and serving as a member of said Board of Supervisors at the August 1935 meeting of said Board of Supervisors attempt, design and endeavor to cheat and defraud…
