HORTON, j.
The petitioner, Rodney E, appeals a decision of the Sullivan County Probate Court {Feeney, J.) terminating his parental rights over Baby K. We vacate and remand.
Rodney E is indigent and presently incarcerated in federal prison in Pennsylvania on a drug offense for which he will likely be released between September 1999 and April 2000. While in pretrial confinement in 1994, he learned that his girlfriend, Mario K., was pregnant with his child.
