HENLEY, Senior Circuit Judge.
The Goodyear Tire and Rubber Company (Goodyear) appeals from a final judgment entered in the district court1 upon a jury verdict finding that Goodyear had discriminated against Robert W. Smith on the basis of age in violation of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 621, et seq. On Goodyear’s motion, the district court set aside the jury’s finding that Goodyear’s actions were willful and Smith cross appeals from that ruling and the denial of equitable relief.
