I. INTRODUCTION

This matter is before the Court on Plaintiffs Motion for Attorney’s Fees and Costs under the Equal Access to Justice Act [Docket No. 30] and on Defendants’ Motion to Dismiss as Moot [Docket No. 38].

II. FACTUAL BACKGROUND

On July 25, 2005, Plaintiff Zheng Liu filed an N-400 Application for Naturalization with the U.S. Citizenship and Immigration Services (“USCIS”). On August 12, 2005, the USCIS requested the FBI name check on Liu. On December 12, 2005, Liu was interviewed by the USCIS in the Saint Paul District Office.…
