Plaintiff' brings this action to recover on an accident policy. The instrument sued on covers plaintiff’s deceased husband. There is no question but what the decedent came to his death under such circumstances that the beneficiary is entitled to recover, if the policy was in force and effect. The question is whether the policy was in effect.

The policy contains a provision' that it shall not be in effect until the first premium has been paid. The company claims that the first premium had not been paid and that consequently the policy was not in force.
