Appeal from an order of the Supreme Court, Erie County (Patrick H. NeMoyer, J.), entered December 19, 2005 in a personal injury action. The order granted the motions of defendants for summary judgment dismissing the amended complaint.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying in part the motion of defendant Douglas Górecki and reinstating the failure to warn and derivative claims against him and as modified the order is affirmed without costs.
