—Appeal from a judgment of the Supreme Court (Torraca, J.), entered August 10, 1998 in Albany County, which, in a proceeding pursuant to CPLR article 78, dismissed the petition for lack of personal jurisdiction.

Following the commencement of this CPLR article 78 proceeding by petitioner, a prison inmate, respondent served a motion to dismiss based upon petitioner’s alleged failure to *521obtain personal jurisdiction.
