On the 23d day of May, 1927, Robert Land, the appellee, 'filed his bill in the chancery court of Wayne county against W. II. Herron and his wife, Violet Herron, and J. C. Brock, trustee, seeking’ the foreclosure of a mortgage executed by W. H. Herron and wife in favor of the former on the 8th day of Obtober, 1917, to secure a note due January 1, 1918, and covering certain land in Wayne county, Miss.
