— Judgment unanimously modified, on the law, and, as modified, affirmed, without costs, in accordance with the following memorandum: Claimant was awarded $125,000 on his claims of false arrest and malicious prosecution. Claimant was a fourth grade teacher who, in response to the misbehavior of a 10-year-old girl in his class, picked her up, placed her on the floor, straddled her legs, and hit her backside approximately 12 times.
