MEMORANDUM OPINION
GRADY, District Judge.
This is an action brought by eleven employees against their employer, The Burlington Northern, Inc. (hereinafter “Carrier”), and against their collective bargaining representative, The Brotherhood of Railway, Airline and Steamship Clerks, Freight Handlers, Express and Station Employees, Lodge No. 1047 (hereinafter “BRAC”), seeking declaratory relief, permanent injunctive relief and damages.
