The plaintiff in the court below brought his action of trespass against a licensed vendor of intoxicating liquors for the recovery of damages for personal injuries resulting from the freezing of his hands and feet to such an extent that the amputation of some of his fingers became necessary, alleging that the proximate cause of such injuries was the intoxicating drink furnished by the defendant to him, whilst in a state of helpless intoxication. That the intoxicating drink was so furnished must have been affirmatively found by the jury, for they were distinctly instructed…
