The plaintiff was employed by the defendant company as a “ dilly rider” at its Black Diamond coal mine in Washington *281county. The mine was worked by a slope and the plaintiff had charge of the train of cars which carried the coal from the interior to the outside of the mine. His duties required him to accompany the cars as they entered and left the mine. As they came out of the mine he occupied a seat provided for him on the front car of the train.
