The two primary issues in this case invoking the original jurisdiction of this Court are: (1) whether there has been compliance with the particular mandate of this Court set forth in Dadisman v. Moore, 181 W.Va. 779, 384 S.E.2d 816 (1989), as modified on reh’g, concerning the underfunding of state employer contributions to the then state division of the West Virginia Public Employees Retirement System for four fiscal years; and (2) whether the amendment in 1990 to W.Va.Code, 5-10-28 eliminating, for most accounting purposes, the two divisions of that System (the state division…
