On March 16, 1978, at approximately 9 a.m. the defendant, Kelvin Wilder, was arrested while carrying a grocery bag containing heroin. He was charged with possession of a controlled substance and possession of a controlled substance with intent to deliver. (Ill. Rev. Stat. 1977, ch. 56/2, pars. 1402(a), 1401(a).) The defendant filed a motion to suppress the physical evidence, which was denied, and defendant then proceeded to a bench trial.
