Appellant, the State of Arkansas, appeals the order of the Pulaski County Circuit Court dismissing the first degree murder charge against appellee Herbert Jones. The state brings this appeal pursuant to Ark. R. Crim. P. 36.10(c), and asserts as the sole point of error the trial court’s denial of its proffered jury instructions for the crimes of murder in the second degree and manslaughter as lesser included offenses of the crime charged.
