In September, 1913, the Gilbert Metals Selling Company, a domestic corporation, had an account with the plaintiff, a national bank. Defendant was a director of the bank and a member of its finance committee. His brother Joseph M. Gilbert was president of the selling company. On a certain day during the month named, Joseph, as president of the corporation, deposited to its credit in the bank, certain checks drawn on out-of-town banks.
