Appeal from an order of the Supreme Court (Aulisi, J.), entered March 20, 2009 in Warren County, which partially granted plaintiffs motion for summary judgment.
In 1997, plaintiff purchased a parcel of real property located in the Town of Bolton, Warren County. The parcel is bordered on the south by Lake George and on the west by defendant’s property, on which a marina has operated since approximately 1922.
