The acceptance of expert witness validation testimony as a viable fact-finding tool in child sexual abuse proceedings (see, e.g., Matter of Nicole V., 71 NY2d 112 [1987]) has given rise to a frequently recurring issue: the appropriateness of a "second” validator’s interview. In both of the cases addressed by this opinion, the respondents have moved for a validation interview in addition to the one conducted by an independent expert selected by the petitioner, the Commissioner of Social Services (hereinafter SSC).
