This action is before the Court on Plaintiff-Petitioner’s Petition for *149Equitable Distribution (“Plaintiffs Petition”) against the Respondent, the Florida Department of Health and Rehabilitative Services (the “Department”), and on the Department’s motions, inter alia, to dismiss or abate the action against it for lack of personal jurisdiction due to insufficiency of process, insufficiency of service of process, failure of Plaintiff-Petitioner to exhaust administrative remedies, and primary jurisdiction of an available administrative tribunal.
