This matter comes before the Court on the Objection to Confirmation filed by Tim Whitmore (“Whitmore”), a creditor in this case and former husband of Louise Marie Sanders (“Debtor”). At the hearing, an issue was raised whether the Georgia statute regarding dormancy of judgments, O.C.G.A. § 9-12-60, applied to bar Whit-more’s claim. Since this issue, if decided in Whitmore’s favor, could affect Debtor’s eligibility to be a Chapter 13 debtor under 11 U.S.C. § 109(e), the Court continued the confirmation hearing and…
