Appellee obtained a verdict and judgment for $6,000 in an action against the City of Chicago for injuries received by him while walking south on the east side of Stony Island avenue in the evening of February 2, 1897. Upon the trial a witness, called by appellee, after testifying to the condition of the sidewalk at the time of the accident, was permitted by the court, over the objections of the defendant, to testify that about the middle of the month of March, after the accident to the plaintiff, in February, he, this witness, at the same place stumbled and fell.
