Proceeding pursuant to *647CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller, which denied petitioner’s application for accidental death benefits. Petitioner’s late husband, Adrian De Leon, was employed by the Fire Department of the City of Buffalo as a fire investigator. He was a member of the Policemen’s and Firemen’s Retirement System.
