MEMORANDUM AND ORDER
FOGEL, District Judge.
Plaintiff in tjhis action, Adelberto Nigro (hereinafter Nigro), filed a com plaint in trespass against the named defendants on July 13, 1973, invoking the diversity jurisdiction of this court pursuant to 28 U.S.C. § 1332(a) (2). 1
