Mr. Justice Green :

The record of the hospital for the insane contained an entry which indicated that the testator’s father was admitted in 1849 to the hospital, because of intemperance continued for six months, and that he was affected with melancholia resulting from intemperance. As there was no proof, and no offer of proof, that this species of melancholia is hereditary, we cannot see the relevancy of the record entry. It may be, or it may not be, that tills form of mental affection is transmissible by inheritance, but we cannot assume that it is, in the absence of proof, and…
