In this action R. S. Turner sued the appellant, Louisville & Nashville Railroad Company, for damages for personal injuries. He recovered a judgment for $1,000, and the railroad company appeals. Various grounds for reversal are urged, but in view of the conclusion of the court, we deem it necessary to consider but the single question whether or not a peremptory instruction should have gone in favor of appellant.
