MEMORANDUM OPINION

TOM S. LEE, District Judge.

This cause came before the court for trial and the court heard testimony from witnesses and reviewed exhibits admitted in evidence. Plaintiffs Charles M. Hill and Judy H. Hill initiated this action in the Circuit Court of Hinds County, Mississippi, alleging in their complaint that defendant March of Dimes Birth Defects Foundation (MOD), acting through its agents, was negligent in failing to adequately warn or instruct Charles M.
