*625In an action to recover damages for personal injuries, etc., the plaintiffs appeal from (1) an order of the Supreme Court, Dutchess County (Dolan, J.), dated December 11, 2002, which granted the defendants’ motion for summary judgment dismissing the complaint, and (2) so much of an order of the same court dated May 13, 2003, as, upon reargument, adhered to the prior determination.
Ordered that the appeal from the order dated December 11, 2002, is dismissed, as that order was superseded by the order dated May 13, 2003, made upon reargument; and it is further,
