This matter is before the Court on Defendant Booker T. Vanderhorst’s Motion to *795Dismiss Counts 1 and 2 of the three-count Indictment filed on April 10, 2013. For the reasons set forth herein, Defendant’s Motion to Dismiss is denied.

BACKGROUND
