Conclusions of Fact—January 18, 1890, appellee delivered to the agent of appellant, at Cleburne, Texas, ninety-four head of cattle to be transported to Chicago, HI., which were delivered in Chicago on January 23, 1890. On account of the failure of appellant’s agents to allow the cattle to be fed and watered for the space of forty-nine hours, the value of said cattle depreciated to the extent of the amount found by the verdict of the jury.
