Plaintiff was struck by defendant’s automobile at the intersection of Fordham Road and Arthur Avenue in the Bronx, at about 9:30 at night on May 28, 1943. Fordham Road runs east and west and Arthur Avenue comes in from the south to a dead end at the intersection. Plaintiff was crossing Fordham Road from north to south on the westerly crosswalk. According to plaintiff’s testimony, when he reached the point on the north side of Fordham Road from which he intended to cross, the traffic light, located on the southeast corner, was green for Fordham Road and red for Arthur Avenue.
