TANG, Circuit Judge:
Appellant George Benny was convicted after a jury trial of twenty-one counts of mail fraud under 18 U.S.C. § 1341-42 and one count of racketeering under RICO provision 18 U.S.C. § 1962(c). The indictment arose out of two related and one unrelated schemes to defraud institutional lenders in the financing of a northern California apartment building and a planned community to be built on a Nevada ranch.
