This is an action for personal injury. The merits of the case are not involved. The questions in dispute relate to the pleadings only.

The action was originally commenced against the City and two others, but at the time of the entry of the judgment appealed from the City was the only defendant. The action was commenced February 25, 1914. The original declaration was filed April 24, 1914. On May 5, 1914, the City filed its plea of the general issue.
