INTRODUCTION

Although discovery is not yet complete, the defendants in this (as yet uncertified) class action suit, CVS Pharmacy, Inc. (“CVS”), Elensys Care Services, Inc. (“Elensys”) and a number of pharmaceutical manufacturers, seek summary judgment on plaintiffs’ claims that the defendants have benefitted financially from a marketing scheme which violated their privacy and other rights.
