—Order, Supreme Court, New York County (Joan Madden, J.), entered December 21, 2001, which, inter alia, denied defendant’s motion for summary judgment dismissing plaintiffs complaint, unanimously modified, on the law, the motion granted to the extent of dismissing the fifth cause of action insofar as plaintiff in that cause seeks to recover costs of a five-year re-audit as an allowable expense for the 1988-1989 school year, and otherwise affirmed, without costs.
