CHUN, J. — Kevin Braa shot Simeon Whitney in a bar fight. Whitney died as a result. A jury found Braa guilty of first degree manslaughter with a firearm and five counts of unlawful possession of a firearm. Following his conviction, Braa moved multiple times for post-conviction DNA testing of evidence from the crime scene to establish a self-defense claim.
