Appeal from an order of the Family Court, Erie County (James H. Dillon, J.), entered March 10, 2004. The order denied the objections of respondent to the order of the Support Magistrate dated November 7, 2003.

*1127It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by granting the objections in part and providing that the payments for educational expenses shall be retroactive to December 10, 2002 and as modified the order is affirmed without costs.
