1. It appearing that this case had been continued at the instance of the defendant one or more times previously to the term at which it was tried, it can not be said that the refusal of the court to continue the case upon the motion of the defendant amounted to such an abuse of discretion as would authorize this court to disturb the judgment of the court below refusing the continuance.
