Appellee, as executor of the will of Joseph A. Welsh, deceased, commenced this action to enjoin appellant, the treasurer of Henry county, Indiana, from collecting from said estate taxes arising out of certain personal property said to have been omitted by testator from his tax returns for the years 1885,1886,1887,1888, 1889 and 1890, and which the county assessor had added to the tax duplicate under the provisions of the tax law of 1891.
